A municipality may pass an ordinance prohibiting video gaming within the corporate limits of the municipality. A county board may, for the unincorporated area of the county, pass an ordinance prohibiting video gaming within the unincorporated area of the county.Allows for the passage of a referendum to prohibit video gaming. At least 90 days before an election in any municipality or county, a petition may be filed, containing the signatures of not less than 25% of the legal voters of that municipality or county. The proposition shall be submitted to the voters of such municipality or county. The question shall be “Shall video gaming be prohibited in _________” (yes/no). If a majority of the voters voting upon such question in any municipality or county vote “yes”, such video gaming shall be prohibited in the municipality or county.
Note: Any local governments who opt-out of video gaming will not receive any payments from the Local Government Video Gaming Distributive Fund.
